Legal Support in Crisis: How We Assist Businesses in Ukraine and Beyond

In 2022, amidst the turmoil of the full-scale invasion of Ukraine by Russia, our law firm made a pivotal decision—to extend our support not only to Ukrainian refugees but also to businesses navigating the complexities of war-torn regions. This journey began with our collaboration with Yevgen Motrich, a lawyer from Rivne specializing in commercial and corporate law and dispute resolution.

Initially, our efforts focused on providing pro bono legal assistance to Ukrainian refugees in Poland. From navigating Polish administrative systems to representing individuals in court, we saw this as a mission to support those in dire need. But as the months passed, a new trend emerged—Ukrainian entrepreneurs seeking opportunities in Poland and international investors exploring the Ukrainian market.

The Evolution of Our Ukrainian Desk

To address these growing needs, we formalized our efforts by creating the Ukrainian Desk—a dedicated team of lawyers and specialists focusing on international transactions, taxation, and investments in Ukraine. While Yevgen brought firsthand expertise in Ukrainian law, our team combined local and international knowledge to offer comprehensive support.

Our Ukrainian Desk also established a network of collaborators, including lawyers, accountants, auditors, and bookkeepers in Ukraine. This network allowed us to provide holistic services to clients, from setting up businesses to managing financial compliance and addressing legal challenges.

Opportunities Amidst Challenges

Despite the ongoing war, the Ukrainian market presents unique opportunities, especially in key sectors:

  • Infrastructure Reconstruction: With significant damage to roads, bridges, and other infrastructure, construction businesses and suppliers of related materials are in high demand.
  • Energy Sector: As traditional energy plants become targets, there’s a push for investments in green energy solutions, supported by incentives from the Ukrainian government.
  • Logistics and Transportation: With airports non-operational, road transport remains vital, creating demand for innovative logistics solutions.

While risks, such as limited access to occupied regions, infrastructure challenges, and workforce shortages, persist, careful planning and legal safeguards can help mitigate these obstacles.

Mitigating Risks Through Legal Expertise

For investors, understanding the legal landscape is crucial. From drafting contracts with arbitration clauses to ensuring compliance with double-tax treaties, we guide our clients at every step. When disputes arise, we advocate for international arbitration or litigation in European courts, ensuring enforceable resolutions.

Collaboration as a Path Forward

The resilience of Ukrainian businesses and their commitment to fulfilling obligations, even during war, has been remarkable. Our collaboration with Yevgen and our broader network reflects our belief in the potential of Ukraine and its people. Whether you’re exploring opportunities in Ukraine or seeking support for your investments, our Ukrainian Desk is here to assist.
